“This is not great, Wayne!” - Our attorney after reading the initial legal documents. ⚖️
Here’s the background: We got served paperwork saying we had improperly used content and owed a lot of back payment for the usage… yikes! 😬
After digging into what happened, we discovered there was an honest mistake made by our team. We believed we had acquired the proper license, but in reality, we had not. This was not good news. 🚨
After speaking with our attorney, we decided it was best to just admit our mistake and try to come to an agreement with the other party.
Here’s the deal: We did screw up, and we had used their content improperly. They were incredibly gracious and understood where the mistake happened. We worked out a fair figure to make the situation right, but it was a significant amount of money for us. 💸
Here are some lessons you can learn:
1. Make sure you have the proper licenses for every library of content you’re accessing, and ensure it allows you to provide that content to 3rd parties if that’s the business you’re in. 📄✅
2. Don’t just quickly check the box that you agree to the terms and conditions with content you’ll be utilizing commercially. 📝⚠️
3. Talk to your staff about these things. New employees may not understand that every industry is different, and tools used in past jobs may not apply in your industry. 👥💡
4. Don’t hide from your mistakes. The other party was awesome and fair. They understood that we made an honest mistake and had no malicious intent. They worked with us to find a resolution. 🤝
As I’ve shared many times, we have no investors at CUENTO Marketing (opens the CUENTO site in a new tab), so mistakes like this and all other expenses come from Katie and I. This one sucked, but I hope it can help someone avoid making the same mistake. 💪
